Kash Kitchen provides a platform connecting home chefs operating under California's MEHKO (Microenterprise Home Kitchen Operation) program with customers seeking homemade meals. This service is provided "as is" and "as available" without any warranties, express or implied. You agree to use the website and services only for lawful purposes and in accordance with these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not use the service to engage in any fraudulent, abusive, or illegal activity. We reserve the right to suspend or terminate accounts that violate these terms or engage in behavior that harms our platform, our users, or our reputation. You must not interfere with the operation or security of the service, attempt to gain unauthorized access to other accounts or systems, or use automated tools to scrape or extract data from our platform.
2. Chef and Customer Responsibilities
For Chefs: Home chefs using our platform must maintain all required permits, licenses, and certifications under California law, including valid MEHKO permits and liability insurance. Chefs are responsible for food safety, accurate menu descriptions, proper pricing, and timely fulfillment of orders. All food must be prepared in compliance with health department regulations and MEHKO program requirements.
For Customers: Customers are responsible for providing accurate delivery information, being available to receive orders, and communicating any dietary restrictions or allergies to chefs. Payment is required at the time of order placement. Customers should inspect food upon delivery and report any issues within 24 hours. We encourage respectful communication between customers and chefs to ensure a positive experience for everyone.
3. Intellectual Property
All content on this website, including but not limited to text, images, logos, graphics, videos, recipes, and software, is the property of Kash Kitchen or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or publicly perform any content from this website without our express written permission.
User-generated content, such as chef profiles, food photos, and reviews, remains the property of the user who created it. However, by submitting content to our platform, you grant Kash Kitchen a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for the purpose of operating and promoting our service. You represent that you have all necessary rights to the content you submit and that it does not violate any third-party rights.
4. Payment and Refunds
All payments are processed securely through our payment partner, Stripe. We accept major credit cards, debit cards, and other payment methods as indicated at checkout. Prices are set by individual chefs and may vary. Minimum order amounts and delivery fees apply as specified by each chef. Refund eligibility is determined on a case-by-case basis. We encourage customers and chefs to resolve issues directly first. In cases of legitimate food safety concerns, non-delivery, or significant quality issues, we will work with both parties to reach a fair resolution, which may include partial or full refunds at our discretion.
5. Limitation of Liability
Kash Kitchen acts as a marketplace platform connecting chefs and customers. We do not prepare food, provide catering services, or control the quality, safety, or legality of items offered by chefs. To the fullest extent permitted by law, we are not liable for any damages or losses resulting from your use of the website, including but not limited to: foodborne illness, allergic reactions, property damage, financial loss, or any other direct, indirect, incidental, or consequential damages.
You acknowledge that food preparation involves inherent risks and that chefs are independent operators responsible for their own actions. We strongly recommend that customers communicate dietary restrictions and allergies clearly and that chefs maintain appropriate liability insurance coverage. Your use of the platform is at your own risk, and you agree to hold Kash Kitchen harmless from any claims arising from transactions between chefs and customers.
6. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and protect your personal information. By using our service, you consent to our data practices as described in the Privacy Policy. We use industry-standard security measures to protect your data, but no method of transmission over the Internet is completely secure.
